Regarding setting new minimum retail prices for vermouth and other grape wines with addition of vegetable or aromatic substances, taking into account provisions of the Resolution of the Cabinet of Ministers of Ukraine as of 13.01.2021 № 17 “On Amendments to the Resolution of the Cabinet of Ministers of Ukraine as of 30.10.2008 № 957”.

Resolution of the Cabinet of Ministers of Ukraine as of 13.01.2021 № 17 “On Amendments to the Resolution of the Cabinet of Ministers of Ukraine as of 30.10.2008 № 957” (hereinafter – Resolution № 17) amended appendix to Resolution № 957 as of 30.10.2008 “On setting size of the minimum wholesale and retail prices for certain types of alcohol beverages”.

Resolution № 17 was officially published in a newspaper “Uryadovyy kuryer” № 10 from 16.01.2021 and comes into force 10 days after its publication, namely on 26.01.2021.

Resolution № 17 amended establishment of size of the minimum wholesale and retail prices for certain types of alcohol beverages, namely:

the minimum retail price 49 UAH for “Vermouth and other natural grape wines with addition of plant or aromatic extracts in glass containers with a capacity of 0.7 liter, in other containers with a capacity of 1 liter” according to product codes according to Ukrainian classification of the FEA goods 2205 (excepting 2205 10 10 00 and 2205 90 10 00);

the minimum retail price 109 UAH for “Sparkling wines and aerated wines, fermented beverages, wines (beverages) flavored sparkling (carbonated), the actual strength of which is higher than 1.2 percent by volume of ethyl alcohol but not higher than 15 percent by volume of ethyl alcohol, given that ethyl alcohol contained in the finished product has a completely enzymatic (endogenous) origin, which is bottled in corks with special stoppers for such beverages such as “mushroom”, held in place by means of ties or fasteners, and / or have an excess pressure caused by presence of carbon dioxide in the solution at a level of not less than 1 bar at 20° C temperature in a glass container with a capacity of 0.7 liter and 0.75 liter” according to product codes according to Ukrainian classification of the FEA goods 2204 10, 2204 21 06 00, 2204 21 07 00, 2204 21 08 00, 2204 21 09 00, 2204 29 10 00, 2205 10 10 00, 2205 90 10 00, 2206 00 39 00.

In order to prevent mistakes by economic entities in setting the minimum retail prices for vermouth and other grape wines, with addition of herbal or aromatic substances, it should be borne in mind that:

the minimum retail price 109 UAH is applied to vermouth other grape wines, with addition of vegetable or aromatic substances, which are carbonated, according to product codes according to Ukrainian classification of the FEA goods 2205 10 10 00, 2205 90 10 00 with an actual alcohol concentration of 18 vol.% or less;

the minimum retail price is not applied to vermouth and other grape wines, with addition of vegetable or aromatic substances that are non-carbonated (quiet), according to product codes according to Ukrainian classification of the FEA goods 2205 10 10 00, 2205 90 10 00 with an actual alcohol concentration of 18 vol.% or less;

the minimum retail price 49 UAH is applied to vermouth other grape wines, with addition of vegetable or aromatic substances, according to product codes according to Ukrainian classification of the FEA goods 2205 10 90 00, 2205 90 90 00 with actual concentration of alcohol more than 18 vol.%.

Applying the minimum wholesale and retail prices for certain types of alcohol beverages, particularly vermouth, the norms of Group 22 “Alcohol and non-alcohol beverages and vinegar” of Section IV “Finished food products; alcohol and soft drinks and vinegar; tobacco and its substitutes” of Appendix to the Law of Ukraine “On the Customs Tariff of Ukraine” as of 04.06.2020 № 674-IX.
