In which cases does the controlling body refuse to register software registrars of settlement operations?

Paragraph 6 Section II of Procedure of registration, maintenance of register and usage of software registrars of settlement operations, approved by Order of the Ministry of Finance of Ukraine as of 23.06.2020 № 317 “On amendments to Order of the Ministry of Finance of Ukraine as of 14.06.2016 № 547” with changes and amendments (hereinafter – Procedure№ 317) stipulates that if there are grounds for refusal to register software registrar of settlement operations (abb. PRRO), the fiscal server shall issue a notification on the refusal to register PRRO, indicating grounds for such refusal.

Refusal to register PRRO is formed if:

automated verification revealed non-compliance with general requirements for electronic document management (mandatory and / or consistent signing of electronic document, non-compliance of electronic document with approved format (standard), non-completion of obligatory requisites, invalidity of electronic signatures and / or seals of signatories of the Application for registration of software registrars of settlement operations in the form № 1-PRRO (form identifier J / F 1316604) (Annex 1 to Procedure № 317) (hereinafter referred to as the Application), non-confirmation of the signatory’s right to submit Application, etc.);

PRRO with title and local number indicated in Application has already been registered;

in regard to business unit specified in Application, the business entity did not report about such taxation object to controlling body according to requirements of Paragraph 63.3 Article 63 of the Tax Code of Ukraine as of 02.12.2010 № 2755-VI with changes and amendments or according to such notification, the relevant business unit is closed or not operated by the business entity;

business entity is not included in the Unified State Register of Legal Entities, Individuals – Entrepreneurs and Public Associations;

discrepancies in data specified in Application with data on accounting and registration of business entity as a taxpayer in the controlling body.
