Regarding the sale of goods (services) on the terms of payment by installments

Business entities please note that peculiarities of concluding sales contracts, conditions of payment for sold goods (prepayment (partial or full), on credit or by installments) are regulated by provisions of the Civil Code of Ukraine and relate exclusively to legal relations that arise between the seller and the buyer and are not regulated by the Law of Ukraine № 265 as of 06.07.1995 "On the use of registrars of settlement operations in trade, public catering and services" (Law on RRO) and do not fall within the tax authorities’ competence.

Herewith, the Law on RRO determines that business entities that carry out settlement operations of the sale of goods (services) in trade, public catering and services, as well as operations on acceptance of cash for its further transfer are obliged, in particular, to carry out settlement operations for the full amount of purchase (provision of services) through RRO or software RRO (abb. PRRO) and provide a person who receives or returns goods, receives service or refuses it, with a mandatory settlement document of the prescribed form and content for the full amount of transaction.

As follows, in case of sale of goods (services) on the terms of payment by installments, each settlement operation performed by the business entity must be carried out in compliance with requirements of the Law on RRO, be accompanied by the issuance of settlement document of the prescribed form, content and ensure the combination of issued settlement documents in a chain that will provide opportunity to identify the sold goods.
