One of the priority areas of work of the State Tax Service is combating illegal market of excise goods and encouraging business entities to comply with requirements of tax legislation. Effect of countermeasures for this type of activity is significant, as the legalization of business entities that sell excise goods is additional revenue for the state’s budget.
Employees of the Actual audit department of Main Directorate of the State Tax Service in Dnipropetrovsk region in cooperation with employees of the National Police Department in Dnipropetrovsk region carried out measures aimed at countering illegal turnover of excise goods. According to their results, the sale of tobacco products without excise tax marks and corresponding licenses for the retail sale of tobacco products, namely: electronic cigarettes (Vape) and liquids used for electronic cigarettes, was established.
During the conducted measures, violations of Paragraphs 1 and 2 of Article 3 of the Law of Ukraine № 265/95 as of 06.07.1995 "On the use of registrars of settlement operations in trade, public catering and services" as amended, were found at the economic units, as well as of Articles 11, 15 of the Law of Ukraine № 481/95-VR as of 19.12.1995 "On state regulation of the production and turnover of ethyl, cognac, and fruit alcohol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes, and fuel" as amended. The estimated amount of financial sanctions to business entities is more than 2.2 million UAH.
Employees of the State Tax Service and the National Police Department in Dnipropetrovsk region organized seizure of the counterfeit goods for a total amount of 1.1 million UAH. Based on this fact, protocols were drawn up under Articles 156, 155 and 164 of the Code of Ukraine on administrative offenses.
The case has been sent to the court, which will decide the further fate of offender and the confiscated goods.
Additional 33 economic units began to work in the legal sphere due to the carried out work (registered registrars of settlement operations and received appropriate licenses).
