Court upheld position of the State Tax Service regarding the tax debt collection totaling 177.2 million UAH

Ivano-Frankivsk District Administrative Court supported position of the Western Interregional Directorate of the State Tax Service for work with large taxpayers in case № 2a-2877/11/0970 on the tax debt collection totaling 177.2 million UAH from the taxpayer.

Court agreed with the plaintiff's argumentations that the defendant had a tax debt in 2008 for the total amount of 177.2 million UAH. Such tax debt arose for the taxpayer as of 15.03.2008 as a result of his non-payment of tax obligations determined on the basis of tax notifications-decisions № 0000012600/0, № 0000022600/0 as of 01.09.2004 for a total amount of 75.2 million UAH, as of 09.03.2008 as a result of his non-payment of tax obligations determined on the basis of tax notifications-decisions № 0000142600/0, № 0000152600/0 as of 04.04.2003 for the total amount of 8.7 million UAH and as of 06.05.2008 as a result of his non-payment of tax obligations determined on the basis of tax notifications-decisions № 0001132301/0, № 0001142301/0 as of 09.08.2002 for the total amount of 93.3 million UAH.

According to such circumstances, the Court recognized claims as legitimate and justified in terms of the debt collection from the defendant in the amount of 177.2 million UAH and the litigation as admissible.
