State Tax Service joined the transfer pricing web discussion

State Tax Service of Ukraine took part in web discussion on the topic: "Transfer pricing for 2022: discussing approaches and solutions." Event was organized by the Ukrainian Chamber of Tax Advisers.

Discussion agenda included issues such as profitability ranges for 2022, taxation of constructive dividends and practice of surcharges following audits.

One of the key discussion aspects was practice of applying profitability indicators in controlled operations. For taxpayers who carry out economic activities within the framework of controlled operations, the topic is very important, since correct calculation of profitability can help to avoid tax risks and maintain financial stability of the company.

They also discussed the main factors of attention proving principle of the "arm’s length", which tax authorities are guided by during the audit.

Director of the Transfer Pricing Department of the State Tax Service Kateryna Ryzhenkova reminded of the need to submit a report on controlled operations and notification of participation in an international group of companies, and also emphasized that this year deadline for their submission falls on October, 2.

Question of constructive dividends and their reflection in the reporting has attracted considerable interest of the audience.

Specialists of the State Tax Service recalled recent legislative changes concerning expansion of income, which is equated to dividends, and as a result, increasing the taxpayers’ range.

Experts of the Ukrainian Chamber of Tax Advisers have collected and voiced actual questions of taxpayers that they face in practice. Specialists of the State Tax Service answered these and other questions received from payers in chat.
