RRO/PRRO and fiscal checks are obligatory conditions for protecting consumer rights

Business that sells products and provides services is obliged to provide customers with proper settlement documents. Fiscal check is not a formality. If products turn out to be of poor quality or the service does not meet expectations, it is the check that becomes the only proof of purchase and the key to protecting consumer’s rights: return, exchange or compensation.

RRO/PRRO usage, issuing fiscal checks and providing buyers with appropriate settlement documents were discussed during the meeting. Event was held at the initiative of the State Tax Service of Ukraine by the Office of the Ombudsman for Human Rights of the Verkhovna Rada of Ukraine.

Meeting was attended by representatives of the Office of the Ombudsman for Human Rights of the Verkhovna Rada of Ukraine, Ministry of Finance, Ministry of Economy, National Bank, State Tax Service, State Food and Consumer Service and Public Organization "Association for Protection of Consumer Rights".

Participants, during the discussion, focused on the most pressing questions, including:

- concealment of real volumes of trade proceeds, sale of unaccounted products via the Internet and tax evasion in the online sales;

- consumer rights to receive fiscal check and other supporting documents for returning or exchanging products;

- distinction between banking and non-banking transactions for making settlements using non-banking payment services.

Legal status of payment service providers was separately defined. In particular, it was emphasized that such providers:

- are not participants in the purchase and product sales;

- do not control payment for products (services) by buyers;

- provide exclusively payment services within the scope of issued license;

- issue fiscal checks only within the scope of their obligations, which do not regulate legal relationship between the seller and the buyer.

State Tax Service also informed that due to the new digital service «TAX Control» it is possible to report about possible violations in trade, services or public catering. Access to the service is available 24 hours a day and from any device.
