Execution procedures of court decisions, particularly regarding the registration of tax invoices were discussed during a regular meeting of an expert group of the State Tax Service and the Business Ombudsman Council. Meeting was attended by acting Chairman of the STS Yevhen Oleinikov and Deputy Business Ombudsman in Ukraine Tetyana Korotka. The event was held within a framework of the Memorandum of Partnership and Cooperation concluded between the Business Ombudsman Council and the State Tax Service of Ukraine.
“Obligations of the state to an individual citizen are no less important than the obligations of a citizen to the state. Therefore, when it comes to restoring violated rights – we have full consensus with the Business Ombudsman Council and, accordingly, will continue to work together and develop new forms to accelerate a solution of problematic issues.” – stated acting Chairman of the STS Yevhen Oleinikov.
According to him, currently the execution process of court decisions has accelerated; however, there is a certain category of court decisions in which the STS uses all legal possibilities to persuade the court to cancel them, as they were issued without sufficient grounds. According to some decisions, there are no technical possibilities for their implementation at all.
The main STS’s task in terms of tax control is to ensure fair tax competition. If one of the taxpayers receives illegal competitive privileges due to insufficient payment of taxes – it negatively affects both international image of the state and financing of society’s needs.
“Receipt of complaints by the Business Ombudsman Council is one of the signs of its effectiveness. After all, taxpayers know that appeals to the Business Ombudsman Council are effective, respectively, they will apply more often, thus trying to speed up the execution of court decisions and this is their right” – emphasized Yevhen Oleinikov.
He thanked the Business Ombudsman Council for their principled position, attentive attitude to the verification of appeals and systematic work on their analysis.
Representatives of the STS and the Business Ombudsman Council agreed on further cooperation in improving the execution procedures for enforcement of court decisions and the pre-trial settlement of tax disputes.
