Information about taxpayers, which the State Tax Service will receive as a part of the one-time (special) voluntary declaration, will not be passed to the law enforcement agencies. Tax Code clearly protects secrecy of information about the taxpayer, which the State Tax Service has. This was stated by acting Chairman of the STS Yevhen Oleynikov in an interview with the “LB.ua”.

According to him, retention of data regarding the taxpayer was one of the first requirements, which led to conflicts with other law enforcement agencies.

 “We defended our position in court. And it is as follows: information about the taxpayer can be disclosed in two cases – either he / she gave a written consent or there is a court decision stating that it must be disclosed. Only these cases, not continuous inquiries, when it is asked “give us everything about everyone and everything you have”. No. Sorry, but if the taxpayer disagrees, we will not disclose this information” – emphasized Yevhen Oleinikov.

Acting Chairman also noted that the STS will not conduct taxpayer’s audit in case of an error in filling out the declaration.

“If we find an error in the declaration, we suggest to correct it. If the taxpayer refuses to do so, we simply consider the declaration as not accepted. That’s all. There are no other consequences. That is, we do not go with additional audits. We do not additionally accrue taxes and do not send tax notifications-decisions in this case” – specified Yevhen Oleinikov.

In total, 4.5 million UAH has already been declared for payment within a framework of the one-time (special) voluntary declaration.

Yevhen Oleinikov considers that after the resolution of issues related to banking component, the number of submitted declarations is expected to increase.
