Updated procedure for preliminary coordination of pricing in controlled operations was published on 03.11.2021

Resolution of the Cabinet of Ministers of Ukraine as of 28.10.2021 № 1114 approved new version of Procedure for preliminary approval of pricing in controlled operations, which results in the conclusion of agreements of unilateral, bilateral and multilateral nature for the transfer pricing purposes.

Adopted Resolution provides for:

- application form for preliminary approval of pricing, which is submitted by electronic means;

- submission of application in a single form by large taxpayers wishing to initiate a preparatory consideration of the State Tax Service regarding conduction (termination) of the pricing agreement procedure or procedure of preliminary pricing agreement in controlled operations, extension (termination) of agreement term, objection of agreement termination or price coordination procedures (if such termination was initiated by the STS or simply provide additional documents;

- streamlining procedure for applying to a foreign tax authority in the case of concluding bilateral and multilateral agreements.

Changes are aimed at simplifying processes at all stages of procedure of the pre-approval of pricing in controlled operations, including through their digital development, in particular, during correspondence between the STS and large taxpayer.

Resolution comes into force in a month from the date of its publication but not earlier than 01.01.2022.
