To the attention of taxpayers who use registrars of settlement operations in their activities

Limitation of cash payments between individuals and individuals-entrepreneurs with business entities is established and regulated by the Regulation on conducting cash operations in national currency in Ukraine, approved by Resolution of the Board of the National Bank of Ukraine № 148 as of 29.12.2017 (hereinafter – Regulation № 148).

Also, the specified provision defines Procedure for conducting cash operations in national currency of Ukraine by legal entities (except for banks) and their separate divisions, regardless of the organizational and legal form and ownership form, by state authorities and local self-government bodies during their production, sale, acquisition activities of products or other economic activity (hereinafter – institutions), by individuals that carry out business activities (hereinafter – individuals-entrepreneurs) (hereinafter together in the text – business entities), individuals.

Paragraph 6 Section II of Regulation № 148 stipulates that business entities have a right to make cash settlements within one day according to one or more payment documents:

1) between themselves – in the amount of up to 10000 (ten thousand) UAH inclusively;

2) with individuals – in the amount of up to 50000 (fifty thousand) UAH inclusively.

Payments in the excess of established limit amounts are made through payment service providers by transferring funds from account to account or depositing funds to cash registers of payment service providers for further transfer to accounts. Number of business entities and individuals with whom cash settlements are made is not limited during the day.

Limitation established in Paragraph 6 Section II of this Regulation also applies to settlements during payment for products purchased for production (business) needs with cash received using payment instrument.

Also, Paragraph 7 Section II of Regulation № 148 specifies that individuals have a right to make cash settlements:

1) with business entities within one day for one or more payment documents – in the amount of up to 50000 (fifty thousand) UAH inclusively.

Payments for amount exceeding 50000 UAH are made through payment service providers by transferring funds from account to account or depositing funds to cash registers of payment service providers for further transfer to accounts;

2) between themselves under sales contracts subject to notarization – in the amount of up to 50000 (fifty thousand) UAH inclusively.

Payments for amount exceeding 50000 UAH are made by transferring funds from account to account or depositing and/or transferring funds to accounts.

Taking into account above specified, please note that since Paragraphs 6 and 7 Section II of Regulation № 148 define limitations only for cash settlements, business entities have a right to make non-cash settlements using electronic payment means (POS terminal, Internet acquiring) within one day according to one or more payment documents with individuals and individuals-entrepreneurs without limits on the amount within one day.
