Changes made to the Law of Ukraine № 481/95-VR as of 19.12.1995 " On state regulation of production and turnover of ethyl alcohol, cognac and fruit alcohol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes and fuel " (hereinafter - Law No. 481) entered into force from July 1, 2022. These changes were made by the Law of Ukraine № 1019-IX as of 02.12.2020 "On amendments to certain legislative acts of Ukraine regarding limiting the turnover of excise goods, devices for consumption of tobacco products without combustion and strengthening control of the sale of such goods".
Changes concern the definition of "tobacco products".
From July 1, 2022 – tobacco products are cigarettes with or without a filter, cigarettes, cigars, cigarillos, as well as pipe, snuff, sucking, chewing tobacco, shaggy tobacco and other products made of tobacco or its substitutes for smoking, sniffing, sucking, chewing or heating (Clause 11 of Article 1 of the Law № 481).
From July 1, 2022 – requirements of the Law № 481 are regarding, in particular, but not exclusively:
licensing of their production, wholesale and retail sale (Articles 2-3, Article 15 of the Law №481);
certification of production for compliance with requirements established by the current legislative acts of Ukraine regarding provision of life and health of people, protection of the natural environment, complete technological cycle of production of tobacco products, as well as compliance with sanitary, fire, and environmental norms and rules (Article 8 of the Law № 481);
prosecution for violation of the Law No. 481 (Article 17 of the Law № 481).
