Ways to resolve conflict of interests

Conflict of interests can be resolved:

- independently;

- through external settlement measures

Way of external settlement of conflict of interests:

- removal from the task, actions, decision-making;

- restriction of access to certain information;

- revision of scope of official powers;

- application of external control;

- transfer to another position;

- dismissal.

Conditions for choosing one of resolution methods:

- type of conflict of interests;

- its duration;

- subject for decision on its application;

- presence (absence) of alternative resolution measures;

- presence (absence) of person’s consent to the application of measure;

- possibility of involving other employees in decision-making.

IMPORTANT!

Sequence of actions of the STS’s officials, procedure for taking measures to prevent and resolve conflict of interests and related restrictions in the performance of official duties are defined in Procedure for organizing measures to prevent and resolve conflict of interests in the STS, approved by the State Tax Service on 26.05.2020 № 226.

Decision to resolve conflict of interests is made by issuing a written administrative document of the STS’s Chairman.

Conditions for removing a person from the task:

- real / potential conflict of interests;

- temporary nature of conflict of interests;

- possibility of involvement of another official in decision-making or actions.

Conditions for restricting person’s access to certain information:

- real / potential conflict of interests;

- constant nature of conflict of interests;

- possibility of proper performance of person’s working duties in the position subject to such restriction;

- possibility of entrusting work with relevant information to another employee

Conditions for reviewing the scope of employee’s official powers:

- real / potential conflict of interests;

- conflict of interests of a permanent nature;

- possibility of continuing to perform official duties in the case of such a review and possibility of empowering another person

Conditions of application of external control:

- real / potential conflict of interests;

- conflict of interests of a permanent / temporary nature;

- conflict of interests cannot be resolved in previous ways.

Conditions for official’s transfer:

- real / potential conflict of interests;

- conflict of interests of a permanent nature;

- conflict of interests cannot be resolved in previous ways;

- availability of a vacant position and consent of a person.

Conditions for official’s dismissal:

- real / potential conflict of interests;

- conflict of interests of a permanent nature;

- conflict of interests cannot be resolved in any other way.
