Regional Representative of the Ombudsman of Verkhovna Rada of Ukraine in Dnipropetrovsk region conducted seminar – training for tax employees

Regional Representative of the Ombudsman of Verkhovna Rada of Ukraine in Dnipropetrovsk region Tetiana Koksharova conducted seminar-training on “Compliance with the Laws of Ukraine “On Access to Public Information” for the tax specialists of the Main Directorate of the STS in Dnipropetrovsk region.

Seminar was held with participation of leadership of the MD of the STS and heads of all structural divisions.

Topic of compliance with the requirements of the Law of Ukraine “On Access to Public Information” (hereinafter - the Law) is of the utmost importance as the Tax service often works with such information by the type of activity. This Law defines procedure for execution and ensuring the right of each citizen to access information held by the authorities, other holders of public information specified by the Law and information of public interest.

Regional Representative of the Ombudsman of Verkhovna Rada of Ukraine in Dnipropetrovsk region reminded the STS specialists about the main requirements of the Law and emphasized its important norms.

Tetiana Koksharova noted that all holders of information, irrespective of the legal act under which they act, should be governed by the law when deciding issues regarding access to information.

The law is not applicable in the case of receiving information by authorities during execution of their functions.

The law also is not applicable to relations in the sphere of citizens’ appeals which are regulated by the special law - the Law of Ukraine “On citizens’ appeals”.

Regional Representative of the Ombudsman of Verkhovna Rada of Ukraine in Dnipropetrovsk region focused on business information issues; information that cannot be restricted in access and fees for information.

Tetiana Koksharova paid special attention to refusals regarding requests for information and obligations of the information holders.

“Holders of information must keep a record of requests for information. To ensure saving and access to public information all documents held by the authorities are subject to mandatory registration in the accounting system. All documents of holders, regardless of their contents, form of fixation (paper, electronic), places of creation (created by the holder or received from other individuals), access modes, etc. must be registered in the accounting system. Accordingly, registration and publication of only legal acts of the holder cannot be considered as full compliance with the provision of the Law.” – summarized Tetiana Koksharova.

At the end of the seminar, the tax specialists communicated with Regional Representative of the Ombudsman of Verkhovna Rada of Ukraine in Dnipropetrovsk region on topical issues.
